SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this sweepstakes; by any human error which may occur in the processing of the entries in this sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the sweepstakes, or announcement of the prize[s]. If, in the Administrator's opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, Sponsor reserves the right to request that the Administrator, in its sole discretion, cancel or modify this sweepstakes in a manner deemed appropriate by the Administrator. For the avoidance of doubt, the NWSL is not involved in any way with this Contest and is not responsible for the execution thereof.

  12. General Terms. First Horizon Bank reserves the right, in its sole discretion, to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other cause beyond First Horizon Bank’s reasonable control impairs the integrity or proper function of the Contest. First Horizon Bank is not responsible for any lost, late, incorrect, inaccurate, undelivered, damaged, or delayed entries, whether caused by an entrant or any other technical or human error which may occur in the administration of the Contest and the processing of entries. If for any reason an entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted as a result of First Horizon Bank’s actions, the entrant’s sole remedy is another entry in the Contest, if it is possible.

First Horizon Bank reserves the right, in its sole discretion, to disqualify any entrant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Contest Rules or in any other disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and First Horizon Bank reserves the right to seek damages from any such person to the fullest extent permitted by law. First Horizon Bank’s failure to enforce any term of these Contest Rules shall not constitute a waiver.

  13. Publicity. Each entrant grants First Horizon Bank the right and permission to use his/her entry, name, address (city and state), photograph, likeness, biographical information, statement or voice for advertising, promotional, publicity and/or any other similar purposes in any media without future notice or compensation, except where prohibited by law.
